AN APPEAL hearing in connection with the development that could bring Marks and Spencer back to Scunthorpe is set to take place.A High Court judge had thrown out a legal challenge aimed at derailing the plans, from the owners of Scunthorpe's Foundry shopping centre, and refused a right to appeal.But it has now been revealed that a hearing will take place on Thursday, April 18 at an unspecified location to see whether a fresh appeal can be lodged.
